1. Scope and Platform Operator
1.1. These Terms of Service ("Terms") govern the access to and use of the online marketplace platform handli.ch ("Platform"), operated by Handli ("Operator", "we", "us").
1.2. Handli.ch provides a digital platform connecting private individuals (Peer-to-Peer / P2P) and commercial entities (Business-to-Consumer / B2C) for buying, selling, and advertising goods and services across Switzerland.
1.3. The Operator solely provides the technical infrastructure. Contracts for advertised goods or services are concluded exclusively and directly between the respective buyer and seller. The Operator is not a party to transactions concluded on the Platform.
2. Account Registration and Security
2.1. Registration requires a valid Swiss phone number (+41 prefix) and accurate personal details. Users must be at least 18 years old or have full legal capacity.
2.2. Users are responsible for maintaining the confidentiality of their credentials and for all activities conducted under their account.
2.3. The Operator reserves the right to verify user identities via SMS/WhatsApp One-Time Passwords (OTP) and to block access in cases of suspected toll fraud, bot activity, or breach of these Terms.
3. Listings, Boosts, and Paid Credits
3.1. Users may publish listings subject to platform rules and Swiss law.
3.2. Monetization & Paid Features: The Platform offers promotional features ("Boosts", priority ranking badges, feed highlights) and digital credit bundles.
3.3. Pricing & Payments: Paid features are priced in Swiss Francs (CHF) including applicable taxes. Payment processing is handled via our external payment service provider, Payrexx AG.
3.4. Non-Refundability: Paid listings, boost packages, and credits are consumed upon activation or allocation and are strictly non-refundable, except where required by Swiss statutory law.
4. Prohibited Content and Misuse
4.1. Users agree not to post items or content that violate Swiss law, public decency, intellectual property rights, or third-party rights. Prohibited categories include counterfeit items, illegal drugs, firearms, illegal adult media, and fraudulent financial services.
4.2. Scraping, unauthorized API calls, toll-fraud exploitation, or interference with the platform's security architecture are strictly prohibited and will lead to an immediate permanent ban and potential legal prosecution under Swiss criminal law.
5. Limitation of Liability
5.1. The Operator provides the Platform on an "as is" and "as available" basis. To the maximum extent permitted under Article 100 of the Swiss Code of Obligations (OR), the Operator disclaims all liability for direct, indirect, incidental, or consequential damages resulting from platform downtime, transaction disputes between users, or third-party service interruptions.
5.2. The Operator assumes no warranty for the accuracy, legality, quality, or safety of listed items published by users.
6. Applicable Law and Jurisdiction
6.1. These Terms and any disputes arising out of or in connection with Handli.ch shall be governed exclusively by Swiss substantive law, excluding its conflict of law provisions.
6.2. The exclusive place of jurisdiction for all legal proceedings shall be the competent courts at the registered seat of the Operator in Switzerland.
